Welcome to VISUAILS. These Terms of Service (“Terms”) govern all services provided by VISUAILS (“VISUAILS”, “we”, “us”, “our”) through our website, email, WhatsApp, forms, checkout pages, or any related communication channels.
By placing an order, requesting a sample, using our website, or engaging our services, you agree to these Terms.

1. What VISUAILS Provides
VISUAILS is a managed visual production service for e-commerce brands and businesses. We transform client-provided product materials into commercial-ready visual assets, which may include:

Other related creative deliverables
VISUAILS is a service business. We are not a self-service software platform.
2. Workflow
Our production process include a combination of:

Quality control

Format optimization
The tools used may vary per project.
3. Client Responsibilities
You agree that all materials you submit to VISUAILS are lawful and that you own, control, or are authorized to use them, including:

Logos
-
Brand assets
-
Packaging designs
-
Product names
-
Trademarks
-
Reference images
You are solely responsible for the legality and ownership of submitted materials.
4. Delivery Times
Any delivery time mentioned by VISUAILS, including references such as “within hours”, “24 hours”, or similar, is an estimate only.
Delivery times may vary due to:

Order volume

Complexity
-
Revisions
-
Technical issues
-
Missing client information
-
Holidays or weekends
VISUAILS does not guarantee exact turnaround times unless explicitly agreed in writing.
5. Revisions
Unless otherwise stated, orders may include a limited revision round at our discretion.
Additional revisions, style changes, or changes in project scope may require additional fees.
6. Samples
Free or discounted samples may be offered at our discretion.
Sample offers may be limited to:

One per verified customer
We reserve the right to reject, limit, or cancel sample requests to prevent abuse.
7. Payments
Payment is due at checkout or as otherwise agreed.
VISUAILS may use third-party payment providers. We are not responsible for payment processor outages, delays, or external fees.
Orders may be paused or withheld until payment is received.
8. Refunds
Due to the custom and digital nature of our services, completed work is generally non-refundable.
Refunds or partial refunds may be considered only at our discretion in cases such as:

Duplicate payment

Major failure to provide agreed deliverables
Dissatisfaction based on personal taste alone does not automatically qualify for a refund.
9. Intellectual Property
Until full payment is received, all deliverables remain property of VISUAILS.
After full payment, the client receives a non-exclusive commercial usage license for the final paid deliverables, unless otherwise agreed.
VISUAILS retains the right to:

Before/after showcases
Unless the client purchases or agrees to confidentiality/exclusivity in writing.
10. No Performance Guarantee
VISUAILS does not guarantee:

Sales increases

Conversion rate increases

Ad performance
-
Brand growth
-
Marketplace approval
-
Revenue outcomes
Business results depend on many external factors outside our control.
11. Prohibited Use
You may not use VISUAILS services for:

Illegal products

Fraudulent businesses

Counterfeit goods
-
Hate content
-
Adult illegal content
-
Misleading advertising
-
IP infringement
-
Dangerous or regulated products where prohibited
We may reject any project at our discretion.
12. Limitation of Liability
To the maximum extent permitted by law, VISUAILS shall not be liable for indirect, incidental, lost profit, reputational, or consequential damages.
Our maximum total liability shall not exceed the amount paid by the client for the specific order giving rise to the claim.
13. Account Suspension / Refusal of Service
We may refuse service, cancel orders, or block access where we reasonably suspect:

Fraud

Chargeback abuse

IP violations

Repeated unreasonable demands
14. Governing Law
These Terms are governed by the laws of the Netherlands.
