Legal Disclaimer

1. Nature of the Service
 
VISUA(i)LS provides a fully managed digital visual service for businesses.
 
VISUA(i)LS is not an AI tool, software platform, or automated service.

Artificial intelligence is used solely as part of the internal production workflow. All final visuals are hand-selected, manually refined, and quality-checked before delivery.
 
Clients do not receive access to AI tools, raw AI outputs, prompts, or generation files.
 
 

2. Quality & Expectations


All VISUA(i)LS visuals are produced using the same premium quality standard, regardless of the selected package or subscription.

 

Differences between packages relate only to:

  • number of visuals;

  • flexibility of usage;

  • revisions;

  • model access;

  • delivery priority.

 

VISUA(i)LS does not guarantee that visuals will match subjective personal preferences unless these preferences are clearly communicated during the intake process.


3. Digital Content & Refund Policy
 

All VISUA(i)LS services and deliverables are digital content.

 

Once production has started, all purchases are final and non-refundable, including:

  • one-time packages;

  • subscriptions;

  • add-ons;

  • priority upgrades;

  • custom services.

 

If a delivered visual contains a demonstrable error that falls within VISUA(i)LS’s responsibility, the issue will be reviewed and resolved at VISUA(i)LS’s discretion.



4. Client Responsibilities
 

Clients are responsible for:

  • providing accurate and complete product information;

  • submitting correct reference images and requirements;

  • clearly communicating preferences during intake;

  • reviewing delivered visuals in a timely manner.

 

VISUA(i)LS is not liable for errors or mismatches resulting from incomplete, inaccurate, or missing information supplied by the client.



5. Revisions & Scope of Work
 

Revisions are limited to what is explicitly included in the selected package or subscription.

 

A revision round applies to the entire batch delivered under that order.

 

Revisions are intended for:

  • refinements;

  • stylistic adjustments;

  • updates to existing visuals.

 

Revisions do not include:

  • entirely new creative concepts;

  • new products;

  • fundamentally different styles.

 

Any work outside the original scope requires a new order or written agreement.

 

 

6. Credits & Subscriptions

 

Credits apply only to subscription plans.

  • 10 credits = 1 visual;

  • Credits refresh monthly;

  • Credits do not roll over;

  • Unused credits expire at the end of each billing period.

 

Extra credits can only be purchased with an active subscription.

 

 

7. Delivery Times & Priority
 

All stated delivery times are targets, not guarantees.

 

VISUA(i)LS aims to deliver within 24 hours, but delivery may take longer due to:

  • workload;

  • order complexity;

  • unforeseen circumstances.

 

Priority options affect processing order only, not quality.
VISUA(i)LS is not liable for damages resulting from delayed delivery.

 

 

8. Models & Visual Representation

 

All visuals are stylized representations created through a hybrid AI-assisted process.

 

While VISUA(i)LS strives for high realism and accuracy, absolute real-world accuracy cannot be guaranteed unless explicitly agreed upon in writing.

 

Custom Brand Models and exclusive services are governed by their respective agreements.



9. Usage Rights
 

Clients receive a commercial usage license for all delivered visuals.

 

VISUA(i)LS is not responsible for:

  • platform-specific compliance;

  • advertising rejections;

  • marketing performance or results.

 

Outcomes such as sales, conversions, or engagement depend on factors outside VISUA(i)LS’s control.



10. Intellectual Property
 

Unless otherwise agreed in writing:

  • VISUA(i)LS retains the right to display anonymized visuals for portfolio or promotional purposes;

  • Clients may not resell, sublicense, or redistribute visuals as standalone products.

 

Exclusive services override this clause where applicable.



11. Limitation of Liability
 

VISUA(i)LS shall not be held liable for:

  • indirect or consequential damages;

  • loss of revenue or profit;

  • business interruption;

  • misuse of delivered content.

 

Liability is strictly limited to the amount paid for the specific service in question.



12. Client Responsibility & Misuse

VISUA(i)LS is not responsible for how delivered visuals are used by the client.
Clients are solely responsible for ensuring that all content is used in a lawful, accurate, and non-misleading manner.
 
VISUA(i)LS shall not be held liable for any misuse of delivered visuals, including but not limited to misleading advertising, fraudulent activity, or violations of platform or consumer protection regulations.

 


13. Changes to This Disclaimer

VISUA(i)LS reserves the right to modify this disclaimer at any time.
The most current version will always be available on the website.

Terms & Conditions

1. Definitions
 

  • VISUA(i)LS: the service provider offering managed digital visual services.

  • Client: any individual or business purchasing services from VISUA(i)LS.

  • Visual(s): digital images delivered as part of VISUA(i)LS services.

  • Service(s): all offerings provided by VISUA(i)LS, including packages, subscriptions, add-ons, and custom work.

  • Credits: units used within subscription plans, where 10 credits equal 1 visual.

3. Acceptance of Terms

 

By accessing the VISUA(i)LS website, placing an order, or purchasing any service, the Client agrees to be bound by these Terms & Conditions.

 

If the Client does not agree, they must refrain from using the services.

4. Services & Availability

 

VISUA(i)LS reserves the right to:

  • modify, suspend, or discontinue any service;

  • update pricing, packages, or features;

  • refuse service in cases of misuse, abuse, or unlawful intent.

 

All services are subject to availability and operational capacity.

5. Orders & Payments

​

  • All prices are listed in euros (€), unless stated otherwise.

  • Payments must be completed in full before production begins.

  • VISUA(i)LS uses third-party payment providers and does not store payment details.

 

Failure to complete payment may result in cancellation or delay of services.

 


6. Digital Products & Refund Policy
 

All VISUA(i)LS services and deliverables are digital content.

  • ensuring lawful and non-misleading use of delivered visuals.

VISUA(i)LS is not responsible for errors caused by incomplete, inaccurate, or missing client input.

  • VISUA(i)LS retains ownership of production methods and workflows;

  • Clients may not resell, sublicense, or redistribute visuals as standalone products.

 

VISUA(i)LS may use anonymized visuals for portfolio or promotional purposes unless exclusivity has been purchased.



13. Misuse & Compliance
 

Clients are solely responsible for ensuring that delivered visuals are used in:

  • a lawful manner;

  • compliance with advertising, consumer, and platform regulations;

  • a non-misleading and non-fraudulent way.

 

VISUA(i)LS is not liable for misuse of visuals, including misleading advertising, fraudulent activity, or regulatory violations.



14. Limitation of Liability
 

VISUA(i)LS shall not be liable for:

  • indirect or consequential damages;

  • loss of revenue or profit;

  • business interruption;

  • marketing performance outcomes.

 

Liability is strictly limited to the amount paid for the specific service giving rise to the claim.



15. Termination
 

VISUA(i)LS reserves the right to terminate or suspend services if:

  • these Terms are violated;

  • services are used unlawfully or abusively;

  • payment obligations are not met.

 

Termination does not entitle the Client to a refund.

 


16. Changes to Terms

 

VISUA(i)LS may update these Terms & Conditions at any time.

The most current version will always be published on the website.

 

Continued use of services constitutes acceptance of updated terms.




17. Governing Law
 

These Terms & Conditions are governed by and interpreted in accordance with the laws of The Netherlands.

 

Any disputes shall be submitted to the competent court within that jurisdiction.
